General Terms and Conditions (AGB)

1. Scope

These General Terms and Conditions apply to all orders placed by consumers or businesses through our online shop aji-chili.de with Schulz, Ehsan, Niemann, Dudek GbR, Hedwig-Dohm-Str. 47, 28279 Bremen, Germany (hereinafter "Aji" or "we"). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 BGB).

2. Contracting party, conclusion of contract

The purchase contract is concluded with Schulz, Ehsan, Niemann, Dudek GbR.

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the button "Pay now" / "Zahlungspflichtig bestellen" in the last step of the checkout, you submit a binding offer to purchase the goods in your cart. We confirm receipt of your order immediately by email (order confirmation). The purchase contract is concluded with this order confirmation, at the latest when the goods are shipped.

3. Ordering process and contract text

You place the desired products in the cart, enter your delivery and billing address and the payment method in the checkout, and can review and correct your entries on the overview page before submitting the order, using your browser's back function or the edit links. Clicking the order button submits the order with obligation to pay.

We store the contract text (order data and these terms) and send it to you by email with the order confirmation. The terms can be accessed at any time at aji-chili.de/pages/agb. The contract language is German.

4. Prices and shipping costs

All prices are in euros and include statutory VAT. Shipping costs may apply in addition; they are shown on the page Shipping & Payment, in the cart and in the checkout before you complete your order.

5. Delivery

We deliver within Germany only. Delivery time is 2–4 business days after receipt of payment. Details can be found under Shipping & Payment. If a product is temporarily unavailable, we will inform you without delay and refund any payments already made.

6. Payment

You can pay by credit card, PayPal, Klarna, Apple Pay, Google Pay or Shop Pay. The purchase price is due upon conclusion of the contract. For payments via Klarna, Klarna's terms apply in addition.

7. Retention of title

The goods remain our property until paid in full.

8. Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in our withdrawal policy. Please note the exclusion of the right of withdrawal for opened food products described there.

9. Warranty

Statutory warranty rights apply. In case of transport damage, please contact info@aji-chili.de promptly, ideally with a photo of the damaged delivery; this helps us with the DHL claim but is not a condition for your warranty rights.

10. Liability

We are liable without limitation for damages resulting from injury to life, body or health, in cases of intent and gross negligence, and under the German Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Any further liability is excluded.

11. Product notes

Our sauces are food products. Please observe the information on ingredients, nutritional values, best-before date and storage on the product page and on the label. After opening, keep refrigerated and consume promptly.

12. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).

13. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the state in which they have their habitual residence. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
